Terms of Service

1. Definitions

• "Account" means your user account for the Services.
• "Content" means any text, audio, images, prompts, inputs, outputs, readings, reports, or other materials.
• "User Content" means Content you upload, submit, transmit, or otherwise make available through the Services, including birth information and personal details you provide.
• "Output" means Content generated by the Services (including AI-generated readings, reports, and analyses) based on your inputs.
• "Reading" means an AI-generated fortune reading or analysis produced by the Services based on your birth chart information.
• "Report" means a detailed written analysis available for individual purchase through the Services.

2. Overview of the Services

The Services provide an AI-powered Eastern fortune reading platform based on the ancient art of Saju (Four Pillars of Destiny). The Services allow you to receive personalized birth chart analyses, fortune readings, and life guidance through AI-powered masters via chat or voice interactions.

3. Eligibility and Authority

You must be at least 18 years old to use the Services. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an Account. You agree to provide accurate, current, and complete information and to promptly update it.

4.2 Account Security

You are responsible for maintaining the confidentiality of your credentials and for all activities under your Account. You must notify us promptly of any unauthorized access or security breach. We are not liable for losses caused by your failure to secure your Account.

5. License and Acceptable Use

5.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.

5.2 Prohibited Activities

You agree not to (and not to allow others to):

• Use the Services to defame, harass, threaten, deceive, or harm others.
• Create or distribute Content that is illegal, fraudulent, defamatory, obscene, or that promotes violence or discrimination.
• Upload malware or harmful code, or attempt to damage, disrupt, monitor, or compromise systems.
• Reverse engineer, decompile, disassemble, or attempt to discover source code or underlying models, algorithms, or system prompts.
• Circumvent technical limitations, security measures, or usage restrictions.
• Resell, sublicense, redistribute, or otherwise commercialize the Services or Output, except as expressly authorized by GIGR in writing.
• Impersonate any person or entity or misrepresent affiliation.
• Attempt unauthorized access to any portion of the Services, Accounts, or connected systems.
• Use the Services in violation of applicable laws or regulations.
• Access or use the Services from regions subject to U.S. export controls or sanctions, or in violation of export control laws.
• Provide false birth information or third-party personal data without authorization.

We may monitor usage for security, fraud prevention, abuse detection, compliance, and operational purposes.

6. User Content

6.1 Ownership

You retain ownership of your User Content, subject to the licenses you grant under these Terms.

6.2 Licenses You Grant to GIGR

By uploading or providing User Content through the Services, you grant GIGR a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify, and process your User Content to operate, provide, maintain, and improve the Services.

6.3 Your Responsibilities for User Content

You are solely responsible for your User Content and represent and warrant that:

• You have the right to provide the personal information you submit.
• Your User Content does not infringe or violate third-party rights or applicable laws.
• You have obtained consent from any third party whose personal information you provide.

7. AI-Generated Output

7.1 No Guarantee

You acknowledge and agree:

• No guarantee of accuracy: Output is generated by AI and may contain errors, inaccuracies, or inappropriate results. Readings are for entertainment and personal reflection only.
• No guarantee of uniqueness: Output may be similar to content generated for other users with similar birth chart information.
• Not professional advice: Output does not constitute medical, legal, financial, psychological, or any other form of professional advice.

7.2 Model/Service Changes

Output quality and behavior may change as models, prompts, filters, policies, or systems are updated. We have no obligation to provide backward compatibility or identical results.

8. Fees, Billing, and Refunds

8.1 Per-Report Purchases

The Services offer individual Reports available for one-time purchase. Pricing for each Report is displayed at the time of purchase. By completing a purchase, you authorize us (and our payment processors) to charge your payment method for the stated amount, including applicable taxes.

8.2 Taxes

All fees are exclusive of taxes, and you are responsible for all applicable taxes, duties, and governmental charges.

8.3 Refund Policy

Due to the nature of digital content delivered immediately upon purchase, all payments made to GIGR are non-refundable except where required by applicable law. This includes, without limitation, Report purchases and any other one-time fees.

As a courtesy, GIGR may offer adjustments in limited circumstances at GIGR's sole discretion. Any such courtesy does not create an obligation for future refunds or adjustments.

9. Privacy and Data

We collect and use information as described in our Privacy Policy. By using the Services, you consent to our collection and use of information as set forth in the Privacy Policy, which is incorporated into these Terms by reference.

10. Third-Party Services and Content

The Services may integrate with or link to third-party services (e.g., payment processors, analytics, authentication providers). We are not responsible for third-party services, and your use of them is at your own risk and subject to their terms.

11. Intellectual Property

11.1 Our IP

We own all rights, title, and interest in and to the Services, including software, models, algorithms, interfaces, designs, and trademarks. These Terms do not transfer ownership to you.

11.2 Feedback

If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free right to use, incorporate, and exploit that feedback without compensation.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION, OR THAT OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE. THE SERVICES ARE FOR ENTERTAINMENT AND PERSONAL REFLECTION ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE.

13. Indemnification

You agree to indemnify, defend, and hold harmless GIGR and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Services
• Your User Content
• Any decisions or actions you take based on Output
• Your violation of these Terms
• Your negligence or willful misconduct

We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GIGR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR OUTPUT.

TO THE FULLEST EXTENT PERMITTED BY LAW, GIGR'S TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID TO GIGR FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. Termination

We may suspend or terminate your access to the Services at any time to protect the Services, other users, or GIGR, including for suspected violations of these Terms, security risks, fraud, abuse, or non-payment.

Upon termination or expiration, your access to the Services ends immediately (except as required by law).

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law principles.

16.2 Informal Resolution

Before filing a claim, you agree to contact us at help@gigr.ai to attempt informal resolution. We will attempt to resolve within 60 days.

16.3 Arbitration and Class Action Waiver

If informal resolution fails, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in Delaware (or your location for consumers where required). Disputes must be brought on an individual basis only; you waive class actions and class arbitrations to the fullest extent permitted by law.

17. Changes to These Terms

We may update these Terms at any time. Changes become effective when posted (or as otherwise stated). Your continued use of the Services after the effective date constitutes acceptance.

18. General Provisions

• Entire Agreement: These Terms constitute the entire agreement regarding the Services.
• Severability: If any provision is unenforceable, the rest remains in effect.
• Assignment: You may not assign these Terms without our written consent. We may assign freely, including in a merger or sale.
• No Waiver: Failure to enforce is not a waiver.
• Force Majeure: We are not liable for delays beyond reasonable control.
• Notices: We may provide notices via the Services, email, or posting.
